In February 2019, Attorney Earner consulted on a truck accident case where the jury awarded $6,872,000. The accident occurred in July 2016 on I-84 in New York.
Six jurors found the client was not negligent in the crash, and awarded her and her husband damages including “conscious pain and suffering and loss of enjoyment of life from the date of the accident to the present.”
The jury found that the New Hampshire based trucking company’s driver operated negligently when he crashed into the rear of the clients vehicle, crushing her between his vehicle and the vehicle in front of her. The client broke her back, her sternum her leg, and her ankle in the crash along with a collapsed lung. She required four surgeries and almost 40 days in the hospital and nearly two years of rehabilitation.
Attorney Earner was asked to assist with jury selection and assisted with certain aspects of the trial. Attorney Earner’s experience as a federal interrogator and academic background in Forensic Psychology were highly sought after since the jurisdiction in which the case was brought was notorious for low verdicts.
Note: This case was tried by Trial Lawyer Michael Feldman of Jacoby & Meyers in NYC on behalf of the law firm Finkelstein & Partners in Newburgh, NY. Attorney Earner was brought in to assist with jury selection, scouting and observation.
